1. Acceptance and Scope
These Terms of Service ("Terms") govern your access to and use of SecureShare, including the SecureShare mobile application, website, documentation, and support resources. SecureShare is provided by MagiLand Information Technology Inc. ("MagiLand," "we," "us," or "our").
By downloading, installing, accessing, or using SecureShare, you agree to these Terms. If you do not agree, do not use SecureShare.
2. App Store Terms
If you downloaded SecureShare through the Apple App Store, your use of the app is also subject to Apple's applicable terms, including the Apple Media Services Terms and Conditions and Apple's standard Licensed Application End User License Agreement, unless MagiLand provides a separate custom end user license agreement through App Store Connect.
These Terms are intended to supplement, and not conflict with, Apple's applicable terms. Apple is not responsible for providing maintenance or support services for SecureShare, and MagiLand is solely responsible for SecureShare and its content, subject to applicable law.
3. Limited License
Subject to these Terms, MagiLand grants you a limited, personal, non-exclusive, non-transferable, revocable license to use SecureShare on devices you own or control, solely for lawful personal or internal business purposes and as permitted by the applicable app marketplace usage rules.
MagiLand and its licensors retain all rights, title, and interest in and to SecureShare, including all software, design, branding, documentation, and other intellectual property rights. No rights are granted except as expressly stated in these Terms.
4. What SecureShare Does
SecureShare helps create cleaned copies of selected photos, Live Photos, and videos by removing common metadata categories before saving or sharing. Processing is performed locally on your device, and your originals are preserved unless you separately delete or modify them outside the app.
SecureShare is a privacy-support tool, not a guarantee of anonymity, confidentiality, evidentiary integrity, or secure publication. You are responsible for reviewing cleaned copies before saving or sharing them and for deciding whether, where, and with whom to share them.
5. Metadata and Content Limitations
SecureShare is designed to remove common metadata from supported media files, but it may not remove every possible identifying attribute from every file, format, edited derivative, third-party container, or future media standard.
SecureShare does not detect, blur, redact, or remove visible or audible information inside media, such as faces, reflections, license plates, screens, documents, voices, location cues, background landmarks, or other identifying details. Destination apps and services may also add, infer, retain, or disclose information after you share a file.
6. Your Media and Permissions
You retain ownership of your photos, videos, Live Photos, originals, and cleaned copies. MagiLand does not claim ownership of your media.
You represent that you have all rights, permissions, and lawful authority needed to process, save, and share any media you select. You authorize SecureShare to access and process selected media on your device solely to provide the app functionality you request.
7. Privacy
SecureShare's privacy practices are described in the Privacy Policy, which is incorporated into these Terms. The Privacy Policy explains that SecureShare does not collect app data, does not use analytics or tracking, and processes selected media locally on your device under the current product design.
8. Accounts, Payments, and Availability
SecureShare currently does not require an account, subscription, or in-app purchase. We may modify, suspend, discontinue, or update SecureShare or any feature at any time, subject to applicable law and app marketplace requirements.
Some features depend on iOS, Apple system frameworks, device storage, Photos permissions, iCloud Photos settings, supported file formats, and destination apps or services. MagiLand is not responsible for failures or changes caused by third-party platforms, operating systems, services, or sharing destinations.
9. Acceptable Use
You agree not to misuse SecureShare or use it in a way that violates law, infringes rights, harms others, interferes with the app, or attempts to bypass technical restrictions. You may not copy, modify, reverse engineer, decompile, disassemble, resell, sublicense, or create derivative works from SecureShare except to the extent such restrictions are prohibited by applicable law or permitted by applicable open-source license terms.
10. Third-Party Services
SecureShare may interact with Apple system services, iCloud Photos, the Photos library, share sheets, destination apps, websites, and other third-party services at your direction. Third-party services are governed by their own terms and privacy practices. MagiLand does not control and is not responsible for third-party services, content, storage, processing, or sharing practices.
11. Support
MagiLand may provide support resources, but we do not guarantee any particular response time, availability, fix, workaround, or continued support for any version, device, operating system, or file type. Apple has no obligation to provide maintenance or support services for SecureShare.
12. No Warranty
To the maximum extent permitted by applicable law, SecureShare is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. MagiLand disclaims all warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, error-free operation, and suitability for any particular media file or sharing situation.
Nothing in these Terms limits any warranty, remedy, or consumer protection right that cannot be excluded or limited under applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, MagiLand will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, media, privacy, security, or business opportunity, arising out of or related to SecureShare or these Terms, even if MagiLand has been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, MagiLand's total liability for all claims arising out of or related to SecureShare or these Terms will not exceed the greater of the amount you paid to MagiLand for SecureShare in the twelve months before the claim or CAD $50. This limitation does not apply to liability that cannot be limited under applicable law.
14. Responsibility for Misuse
You are responsible for your use of SecureShare and for any media you process, save, or share. To the maximum extent permitted by applicable law, you agree to hold MagiLand harmless from claims, losses, liabilities, damages, costs, and expenses arising from your unlawful use of SecureShare, your violation of these Terms, or your infringement or violation of another person's rights.
15. Termination
These Terms remain in effect while you use SecureShare. You may stop using SecureShare at any time by uninstalling the app. MagiLand may suspend or terminate your license to use SecureShare if you violate these Terms or if continued access would create legal, security, operational, or rights-related risk.
16. Changes to These Terms
We may update these Terms when SecureShare or our legal, operational, or app marketplace requirements change. The updated Terms will be posted with a new "Last updated" date. Continued use of SecureShare after updated Terms become effective means you accept the updated Terms, except where applicable law requires a different form of notice or consent.
17. Governing Law
Unless mandatory consumer protection law provides otherwise, these Terms are governed by the laws of the Province of Prince Edward Island and the applicable federal laws of Canada, without regard to conflict-of-law rules.
